INTRODUCTION

Laws and Regulations for Federal Oil and Gas Leasing

The statutory authority for the leasing oil and gas is outlined in The Mineral Leasing Act of 1920, as amended, the Mineral Leasing Act for Acquired Lands of 1947, as amended, and the Federal Oil and Gas Royalty Management Act of 1982 (FOGRMA) The BLM processes leasing for all onshore federal minerals.

Regulations that govern the BLM's oil and gas leasing program may be found in Title 43, Groups 3000 and 3100, of the Code of Federal Regulations, a publication available in any BLM State Office, law libraries, and most large public libraries.

Energy & Minerals

BLM, Eastern States manages about 39 million acres of subsurface federal mineral estate.

Currently, we administer 3,300 leases for oil and gas exploration covering about 1.8 million acres, primarily in Arkansas, Louisiana, Mississippi, Michigan, Ohio and West Virginia. More than $405,000 was generated from our December 2000 and March 2001 competitive oil and gas lease sales.

An increase in leasing activity is expected through implementation of the Administration’s new Energy Policy. Critical work activities will remain focused on Oil and Gas Leasing, inspection and enforcement, processing Applications for Permit to Drills, including processing of sundry notices, NEPA, agreements and bond reviews. We performed more than 700 inspections of oil and gas well in FY 2000, and expect to conduct at least 600 inspections in FY 2001. Assignments will also be high priority. Consideration is being given to:

  • Contracting NEPA work;
  • Enhancing E-commerce transactions (applications, approvals, fund transfers);
  • Streamlining the process for obtaining consent from surface management agencies.

Recent comparison of overall satisfaction with the BLM rated Eastern States slightly higher than the three other BLM state offices where oil and gas is a primary program. This customer satisfaction report was prepared for BLM by an independent consulting group in December 2000.

Solid Minerals Leasing activity is expected to remain stable. We will continue core work activities with the most critical functions being inspection and enforcement, verification NEPA, coal leasing, hardrock competitive leasing, post-lease, mining claim recordation and bonding.
